E. Loss of PR Status
A PR remain an alien in the United States. Therefore, it is still possible for the PR to lose PR status if the PR departs the U.S. and it is decided that the PR has abandoned residence here.

Loss of PR status could occur if the PR accepts a permanent job abroad, if the PR fail to file a U.S. resident tax return, if the PR stay outside the U.S. for more than one year without a valid Re-Entry Permit, or if the PR are otherwise found to have abandoned the PR's residence in the U.S.

In determining whether the PR had abandoned residence, the CIS will consider a number of aspects (no one factor is decisive) such as:

evidence of intent to reside in the U.S.;
maintaining assets in the U.S. such as real estate, savings accounts or other investments;
if the PR stay with relatives or friends when here rather than staying in a hotel; and
if the PR continue to pay taxes and retain other property and contacts in the U.S. (such as membership in associations, religious affiliations, credit or brokerage accounts).
The PR does not necessarily have to own or rent a home in the United States, but that is always helpful. On the other hand, if the PR does not spend significant time in the U.S. or have not established a "home" in the U.S., or if the PR enters the U.S. with a wallet or purse full of foreign documents (driver’s license, credit cards, etc.), or refers to the PR's residence overseas as "home", that may call attention to a possible loss of residence.

The PR could also lose the PR's status if convicted of a crime involving moral turpitude or other serious offenses. Minor drug offenses may result in loss of PR status as well. The PR should consult us if the PR is arrested for any reason at all.

The PR may also lose the PR's status if it is determined that the PR was ineligible for PR status at the time of receiving it. This can happen if the PR worked or remained in the U.S. without CIS authorization prior to adjusting the PR's status.

The PR may also be found ineligible for PR status if the PR separated from the spouse or employer who petitioned for the PR shortly after obtaining the PR's status or separated from the PR's spouse or terminated employment before obtaining PR status. The PR should consult with us before taking such action. These matters must be taken seriously. Even a person who has lived in the U.S. as a PR since early childhood may lose his or her status and face deportation proceedings.

It is only when a PR becomes a naturalized citizen that U.S. immigration laws no longer apply to him or her.
