◇◇新语丝(www.xys.org)(xys.dxiong.com)(xys.3322.org)(xys.freedns.us)◇◇   从《司法过程的性质》一书看苏力的翻译   pony   就本人阅读《司》书(部分) 之后的感觉而言,苏力在《司》书中体现的翻 译水准是高于目前国内大多数法学(和其他社会科学)译著的翻译水准的,但的确 未达到一名学术大师所应达到的水准。考虑到《司》书是作为商务印书馆《汉译 世界学术名著丛书》之一出版的,《司》书的翻译水准应该说不能令人完全满意。   以下本文作者试图从一些细节来分析《司》书中的误译或错译。由於本人学 识和时间有限,以下所述,错误之处,在所难免。本文目的在于抛砖引玉。还请 各位指正。   对相关法律概念缺乏了解   《司》书第37页有一句译文为:“这些权力也许是如此之众所周知,以致于 法院都会慎重周全地考虑到这些权力。” 卡多佐的原文为:“They (the powers) may be so well known that the courts will notice them judicially.” 苏 力似乎不知道 “judicial notice” 这一法律术语。Judicial notice: A court’s acceptance, for purpose of convenience and without requiring a party’s proof of a well-known and indisputable fact...[Black’s Law Dictionary, Abridged 7th Edition, P. 684]. 司法认知(judicial notice) 又称审判上的知悉。在民事诉讼中,当法院依职权对有关当事人的事实主张采用 司法认知时,便可免除其该当事人对该事实主张的举证责任[毕玉谦,《试论民 事诉讼中的司法认知》, http://www.civillaw.com.cn/weizhang/default.asp?id= 9371] 。因此,卡多 佐的这句话的意思应该是:“这些权力也许如此之众所周知,以致于法院会对其 作出司法认知。”   语句不通   《司》书第2页有一句译文为:“即使决定这一选择的那些因素和动机常常 模糊不清,却也并非不完全无从分析。” “却也并非不完全无从分析” 这一说 法不通。卡多佐的原文为:“and the considerations and motives determining the choice, even if often obscure, do not utterly resist analysis.” 对照卡多佐的原文,“却也并非不完全无从分析” 应为“却并非 完全无从分析” 。   类似的,《司》书第20-21页有一句译文为:“没有人比他更清楚地理解, 尽管分析性技术是一个不可缺少的工具,但对律师来说,它并为不是一个完全足 够的工具”。“它并为不是一个完全足够的工具” 这一说法不通。卡多佐的原 文为:“ no one saw more clearly than he that while the analytical matter is an indispensable tool, it is not an all-sufficient one for the lawyer.” 对照卡多佐的原文,“它并为不是一个完全足够的工具” 应为 “它并不是一个完全足够的工具” 。   《司》书第36-37页有一句译文为:“公共的和私人的公司的责任也许是保 持这种可流通品质,尽管票据上有印章,尽管按照普通法印章会毁了票据。” 卡多佐的原文为: “The obligations of public and private corporations may retain the quality of negotiability, despite the presence of a seal, which at common law would destroy it. ” “也许是保持这种可流通品质” 不通。根据上下文,似应改为“仍可以保持可流通性” 。[See Black’s Law Dictionary, Abridged 7th Edition, P. 795. May: 1. Is permitted to . * this is the primary legal sense—usu. Termed the “permissive” or “discretionary” sense. 2. Has a possibility (to); might ….]. “印章 会毁了票据” 应改为“印章会毁了(票据的)可流通性” ,因为原文中的 “destroy it” 是指destroy the quality of negotiability。   《司》书第37页有一句译文为:“法院或普通法的一个仅仅是技术性的教条 不可能禁止商业世界发明或发行上个世纪所没有任何类型的证券。” “上个世 纪所没有任何类型的证券” 不通, 应为“上个世纪所没有的任何类型的证券” 。   用词不够准确   《司》书第11页有一句译文为:“50年前,我想,作为一个一般性原则,当 时会这样说,只要甲的活动不造成公害,甲就可以随其所愿地从事自己的生意, 哪怕其目的是要伤害乙。” 卡多佐的原文为:“Fifty years ago, I think it would have been stated as general principle that A may conduct his business as he pleases, even though the purpose is to cause loss to B, unless the act involves the creation of a nuisance.” 对照卡多佐的原文, “伤害乙” 似应改为“给乙带来损失(损害)” 。在中文中,“伤害”在通常意 义上讲,是针对人身(肉体和精神)的。而卡多佐原文中的“cause loss to B ” 应主要是财产上的。这一点从卡多佐举的例子可以看出。卡多佐举的例子如下: “Spite fences were the stock illustration, and the exemption from liability in such circumstances was supposed to illustrate not the exception, but the rule.” 而“Spite fences” 是什么呢?Spite fence: a fence erected solely to annoy a neighbor, as by blocking the neighbor’ s view or preventing the neighbor from acquiring an easement of light. [Black’s Law Dictionary, Abridged 7th Edition, P. 1132-33]. 也就是说, “Spite fences” 损害的是邻居的视野或采光。   前后不一致(可能是校对不严格导致的)   《司》书对 “seal” 这一词给出了两种译法,而卡多佐的原文不同的地方 中对“seal” 的使用看不出有什么不同[司书第37页译为“印章” ,第97页译 为“印玺” 。卡多佐的原文:第61页,“The obligations of public and private corporations may retain the quality of negotiability, despite the presence of a seal, which at common law would destroy it. ” 第155 页, “It is another rule of the common law that a parol agreement, though subsequently made,is ineffective to vary or discharge a contract under seal. In days when seals counted for a good deal, there may have been some reason in this recognition of a mystical solemnity.”   类似的,《司》书第43页将“fissure” 译为“缝隙”,但在115页中的索 引中出现的却是“裂缝” ;《司》书第63页将“juristic philosophy” 译为 “法律哲学”,但在114页中的索引中出现的却是“哲学” 。 (XYS20040823) ◇◇新语丝(www.xys.org)(xys.dxiong.com)(xys.3322.org)(xys.freedns.us)◇◇
