首先, J.D.Cadidate 在美国是属于graduate student,而不是undergraduate student(有兴趣可以去查一查J.D.的学生卡档案)。而字典的根据如下: the law degree granted upon graduation by many university law schools with accepted high standards of admission and grading. This often supersedes the Bachelor of Laws in recognition that the law curriculum entitles a person to a graduate degree. (http://dictionary.law.com/definition2.asp?selected=1073&bold=||||)

根据这一段解释结合美国法学院改制的历史, 我们可以看出J.D.之所以后来取代L.L.B. 是为了认可“法学院教育理应让学生拿到研究生学位。”(in recognition that the law curriculum entitles a person to a graduate degree.)所以说这一博士头衔不仅仅是一个虚妄的称谓,而是一个官方认可的研究生学历。您所提供的字典的解释实际上也承认J.D. 是经过三年的post-graduate law study 才能拿到。(J.D. is an abbreviation for the Latin Juris Doctor, also called a Doctor of Law or Doctorate of Jurisprudence, and is the law degree typically awarded by an accredited U.S. law school after successfully completing three years of post-graduate law study. 至于您说的因为J.D.是法学院的first degree,所以只是一个本科的学位。我认为first degree只是说明在法学院内部J.D.是一种基础学位。但first degree决不等同于本科学位。美国一向是以undergraduate和graduate来界定本科和研究生学位,而不是以first degree 和 second degree。实际上攻读J.D.是以拿到法学预科的学士学位和其他同等学位为前提条件的。


个人认为,翻译学位,应该依据学位授予国的标准和认知,而不是强行类比中国或者第三国的标准并采用一个最低标准,更不能拿60年代的学位标准来否定几十年后的学位标准。世易时移,变法宜矣。既然美国都将之定名为博士,并且归之于研究生,我们还要强求许博士将他的J.D.学位翻译为学士,是不是有一点吹毛求疵了?
